Welcome to Rose Hill Care At Home Inc. By using our website and registering as a Personal Support Worker (PSW), you agree to comply with and be bound by the following Terms and Conditions. These Terms and Conditions govern your employment relationship with Rose Hill Care At Home Inc. and outline the legal obligations under Ontario laws and regulations for PSWs. Please read them carefully.

Beginning on July 1, 2024, under the Employment Standards Act, 2000 (ESA), Rose Hill Care At Home Inc. operates as a licensed temporary help agency. As such, the following Terms and Conditions govern your registration and employment as a Personal Support Worker (PSW) with our agency. By registering on our website, you acknowledge and agree to these conditions, which outline your rights, obligations, and the legal framework governing our relationship.

  1. Temporary Help Agency Licensing

Rose Hill Care At Home Inc. holds the necessary license to operate as a temporary help agency. Under the ESA:

  • Clients are prohibited from knowingly engaging the services of a temporary help agency unless that agency holds a valid license.
  • Recruiters must also hold a license to act as a recruiter. Employers, prospective employers, and other recruiters cannot knowingly engage the services of any unlicensed recruiter.

  1. Employment Relationship

By registering as a PSW with Rose Hill Care At Home Inc., you understand and agree that:

  • After you signed the Employment Agreement, you are an employee of Rose Hill Care At Home Inc., either on a full-time or part-time basis, depending on the needs of the company and its clients.
  • Your work schedule, duties, and assignments will be determined based on client needs and operational requirements.
  • You are expected to adhere to all policies, procedures, and care standards established by the agency.
  1. Eligibility Requirements

To be eligible for employment as a PSW, you must meet the following criteria:

  • Completion of Approved Education Programs: You must have completed a PSW training program approved by the Ontario Ministry of Colleges and Universities or an equivalent recognized program.
  • Certification: Valid First Aid and CPR certifications are required.
  • Criminal Background Check: An up-to-date Criminal Record Check with a Vulnerable Sector Screening is mandatory.
  • Eligibility to Work: You must be legally authorized to work in Ontario and possess a valid Social Insurance Number (SIN).
  • Health Requirements: Compliance with vaccination requirements as specified by the Ontario Ministry of Health for healthcare workers.

By accepting employment, you affirm your compliance with these eligibility requirements and agree to maintain valid documentation throughout your tenure.

  1. Job Responsibilities

As a PSW employed by Rose Hill Care At Home Inc., you will be responsible for:

  • Providing care to clients as per their individualized care plans, including personal care, assistance with activities of daily living, and companionship, as required.
  • Adhering to professional standards and obligations outlined under the Long-Term Care Homes Act (2007) and other relevant Ontario laws.
  • Upholding client dignity, respect, and autonomy in all interactions.
  • Maintaining confidentiality of client information in compliance with the Personal Health Information Protection Act (PHIPA).
  • Complying with health and safety regulations as per the Occupational Health and Safety Act (OHSA), including infection control practices and proper use of personal protective equipment (PPE).
  1. Employment Status and Hours of Work

Your employment status will be defined as either:

  • Full-time: Employees who work a minimum number of hours as determined by the agency.
  • Part-time: Employees who work fewer hours based on client needs and assignment requirements.

Work schedules and assignments may change depending on operational demands, and the agency will provide reasonable notice for such changes.

  1. Compensation and Benefits

Your compensation will be outlined in your employment contract, detailing:

  • Hourly wages or salary rates based on your position and experience.
  • Overtime pay in compliance with the Employment Standards Act (ESA).
  • Employee benefits, if applicable, based on your employment status with the agency.
  1. Professional Obligations under Ontario Law

As a PSW, you must:

  • Follow the Code of Conduct for PSWs established by the Ontario Ministry of Health and Long-Term Care.
  • Maintain professional development by keeping current with required training and certifications.
  • Adhere to privacy and confidentiality requirements when handling client health information.
  • Report any incidents of client abuse, neglect, or safety concerns to agency management in accordance with Ontario’s mandatory reporting laws.
  1. Termination of Employment

Rose Hill Care At Home Inc. reserves the right to terminate your employment if you fail to:

  • Comply with these Terms and Conditions.
  • Adhere to applicable Ontario laws and regulations.
  • Meet the performance and care standards established by the agency.

Termination may occur for misconduct, falsification of information, client complaints, or violations of agency policies, following the procedures outlined in the Employment Standards Act (ESA).

  1. Liability and Indemnification

While Rose Hill Care At Home Inc. strives to create a safe and supportive work environment, as a PSW:

  • You agree to follow all agency policies, procedures, and safety protocols.
  • You acknowledge that Rose Hill Care At Home Inc. is not liable for personal injury, loss, or damage incurred while providing services, except where such injury or loss arises from the agency’s negligence.
  1. Waiver of Responsibility

Rose Hill Care At Home Inc. provides guidance, procedures, and support to all PSWs. However:

  • Rose Hill Care At Home Inc. disclaims liability for any misconduct, negligence, or legal disputes arising from your actions while performing your duties.
  • You remain responsible for ensuring compliance with legal standards of care and for providing services ethically and professionally.
  1. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes arising from these Terms and Conditions or your employment will be subject to the exclusive jurisdiction of the courts of Ontario.

Rose Hill Care At Home Inc. operates as a temporary help agency, providing staffing solutions to clients. By accepting employment, you agree that the agency shall not be held liable for any claims, injuries, or disputes arising from your provision of services, except as mandated by law. All PSWs are expected to comply with Ontario regulations and uphold a high standard of professional conduct.

By registering with Rose Hill Care At Home Inc. and providing your personal information, you authorize the agency to collect, use, and disclose your name, photo, contact information and a brief description for promotional and operational purposes on our website and other marketing materials. This may include, but is not limited to, showcasing staff profiles, testimonials, and other content that highlights our services and team members. Your information will be handled in accordance with applicable privacy laws and regulations, and you may withdraw your consent at any time by contacting us directly.

By registering as a PSW and accepting employment with Rose Hill Care At Home Inc., you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
