By accessing or using our website, submitting a form, registering as a client, requesting services, applying to work with us, or otherwise communicating with us, you agree to comply with and be bound by these Terms and Conditions.

These Terms and Conditions govern the use of our website, client registration, service requests, worker applications, and general expectations for clients, employees, contractors, Personal Support Workers, Registered Nurses, caregivers, and other service providers.

These Terms and Conditions do not replace any signed client service agreement, employment agreement, contractor agreement, care plan, confidentiality agreement, policy, or other written agreement between you and Rose Hill Care at Home Inc.

If you do not agree with these Terms and Conditions, please do not use this website or submit information through it.

1. Overview

Rose Hill Care at Home Inc. provides in-home care, staffing, personal support, nursing support, companionship, and related services to clients, families, organizations, and care partners in Ontario.

Rose Hill Care at Home Inc. may provide services through employees, independent contractors, Personal Support Workers, Registered Nurses, caregivers, companions, administrative staff, and other qualified service providers, depending on the service requested, the client’s needs, availability, applicable law, and the agreement between the parties.

By using this website, registering as a client, requesting services, or applying as a worker, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

2. Temporary Help Agency Licensing

Rose Hill Care at Home Inc. operates as a licensed temporary help agency in Ontario.

Beginning July 1, 2024, temporary help agencies in Ontario are required to hold a valid license to operate, unless a legal transitional rule applies. Clients are prohibited from knowingly engaging or using the services of a temporary help agency unless the agency holds a valid license.

Rose Hill Care at Home Inc. maintains the license required for its temporary help agency operations.

3. Temporary Help Agency License Number

Where Rose Hill Care at Home Inc. assigns workers to client homes, facilities, organizations, or other client locations, Rose Hill Care at Home Inc. will operate in accordance with applicable Ontario laws and licensing requirements.

Nothing in these Terms and Conditions removes, reduces, or limits any rights, obligations, or protections under the Employment Standards Act, 2000, the Occupational Health and Safety Act, the Human Rights Code, privacy laws, health information laws, workers’ compensation laws, or any other applicable Ontario or Canadian law.

4. Website Usage

The Rose Hill Care at Home Inc. website is provided for general information about our services, locations, employment or contractor opportunities, and ways to contact us.

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use and enjoyment of this website by any other person.

You must not use this website:

  • for any unlawful, fraudulent, abusive, harmful, or misleading purpose;
  • to submit false, incomplete, or misleading information;

6. Services

Rose Hill Care at Home Inc. provides in-home care and related support services in compliance with applicable federal, provincial, and local laws.

Services may include, depending on client needs, worker qualifications, availability, and applicable law:

  • Personal Support Worker services;
  • Registered Nurse services;
  • personal care;
  • companionship;
  • assistance with activities of daily living;
  • respite care;
  • dementia and memory care support;
  • post-hospital support;
  • medication reminders or medication support where permitted;
  • wound care or nursing services where permitted and provided by qualified staff;
  • vital sign monitoring;
  • care coordination;
  • staffing support for clients, organizations, or facilities;
  • other services agreed to in writing.

The exact services, schedule, fees, cancellation rules, responsibilities, and limits of service will be confirmed in a separate client service agreement, care plan, quote, invoice, online checkout page, written confirmation, or other agreement.

Rose Hill Care at Home Inc. does not guarantee that every requested service can be provided.

7. Client Registration and Service Requests

To register as a client or request services, you may be required to provide accurate and complete information as prompted during the registration or intake process.

You are responsible for ensuring the information you provide is accurate, complete, and current.

Submitting a form, registering as a client, or requesting services does not guarantee that services will be provided. Rose Hill Care at Home Inc. may contact you to request more information, assess service suitability, confirm availability, explain service options, provide pricing, and confirm next steps.

If you create an account on our website, you are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account.

8. Client and Family Responsibilities

Clients, family members, representatives, substitute decision-makers, and authorized contacts must provide accurate and complete information required to assess, arrange, provide, supervise, and manage services.

Clients and their representatives are responsible for providing a safe, respectful, and appropriate environment for Rose Hill Care at Home Inc. employees, contractors, PSWs, RNs, caregivers, companions, and other workers.

Rose Hill Care at Home Inc. may refuse, suspend, change, or end service where there is:

  • abuse, harassment, threats, violence, or intimidation;
  • discrimination;
  • unsafe working conditions;
  • unsanitary or hazardous conditions;
  • illegal activity;
  • failure to provide necessary information;
  • failure to pay required fees;
  • repeated cancellations;
  • requests outside the agreed care plan;
  • requests outside the worker’s qualifications, training, legal authority, or professional scope;
  • any situation that creates unreasonable risk to the client, worker, Rose Hill Care at Home Inc., or others.

Clients and families must not ask Rose Hill workers to perform tasks outside the agreed care plan or outside their qualifications, training, legal authority, or professional scope.

9. No Private Hiring or Side Arrangements

Clients, families, representatives, and other service recipients must not privately hire, solicit, pay directly, or make side arrangements with Rose Hill Care at Home Inc. employees, contractors, PSWs, RNs, caregivers, companions, or staff outside Rose Hill’s normal service process unless Rose Hill gives written approval.

This restriction helps protect clients, workers, scheduling, insurance, supervision, privacy, continuity of care, and Rose Hill Care at Home Inc.’s business relationship with its clients and workers.

10. Employment Relationship

By registering, applying, uploading documents, or communicating with Rose Hill Care at Home Inc., you understand and agree that submitting an application does not automatically create an employment relationship, contractor relationship, placement, assignment, or guarantee of work.

A person becomes an employee, contractor, assignment worker, or other service provider of Rose Hill Care at Home Inc. only after Rose Hill has reviewed the application, completed its required checks, made an offer, and the person has signed the required employment agreement, contractor agreement, onboarding documents, or other written agreement required by Rose Hill.

Rose Hill Care at Home Inc. may engage workers as employees, independent contractors, casual workers, part-time workers, full-time workers, temporary help agency assignment workers, or assignment-based workers, depending on the role, business needs, applicable law, and the written agreement between the parties.

Your work schedule, duties, assignments, reporting obligations, and service locations may be determined based on client needs, operational requirements, worker qualifications, availability, applicable law, and the applicable written agreement.

All employees, contractors, PSWs, RNs, caregivers, companions, and other workers are expected to follow Rose Hill policies, procedures, care standards, confidentiality requirements, privacy obligations, health and safety requirements, infection control practices, and applicable laws.

11. Eligibility Requirements

To be considered for work with Rose Hill Care at Home Inc., applicants and workers may be required to meet eligibility requirements depending on their role.

Eligibility requirements may include:

  • proof of identity;
  • proof of eligibility to work in Canada;
  • valid Social Insurance Number, where required for employment or payroll purposes;
  • completion of a PSW training program, equivalent training, or other education acceptable to Rose Hill, where applicable;
  • nursing registration with the College of Nurses of Ontario, where applicable;
  • valid First Aid and CPR certification, where required;
  • up-to-date Criminal Record Check or Vulnerable Sector Check, where required;
  • employment references;
  • resume or work history;
  • proof of relevant experience;
  • immunization, TB testing, vaccination, or other health-related documentation where required by law, client-site rules, public health guidance, or Rose Hill policy;
  • driver’s license and vehicle insurance, where driving is required;
  • professional insurance, where applicable;
  • other documents, training, checks, or certifications reasonably required for the role.

By accepting employment, contractor work, assignment work, or any service role with Rose Hill Care at Home Inc., you affirm that the information and documents you provide are accurate, complete, valid, and current.

Rose Hill Care at Home Inc. may reject, pause, suspend, or end an application or working relationship if information is incomplete, inaccurate, expired, unverifiable, misleading, or does not meet the requirements of the role.

Workers are responsible for maintaining valid required documentation throughout their relationship with Rose Hill Care at Home Inc.

12. Job Responsibilities

Employees, contractors, PSWs, RNs, caregivers, companions, and other workers may be responsible for providing services to clients according to their role, qualifications, applicable care plans, assignment details, and Rose Hill policies.

Responsibilities may include:

  • providing care to clients according to individualized care plans;
  • assisting with personal care and activities of daily living;
  • providing companionship and support;
  • supporting client comfort, dignity, independence, and safety;
  • following infection control practices and proper use of personal protective equipment, where required;
  • following medication reminder or medication support instructions only where permitted and authorized;
  • providing nursing services only where qualified, authorized, and permitted by law;
  • documenting care notes, incidents, changes, or concerns where required;
  • following client-site rules, where applicable;
  • communicating with Rose Hill supervisors, schedulers, and authorized contacts as required;
  • reporting safety concerns, care concerns, incidents, suspected abuse, neglect, privacy concerns, or workplace injuries as soon as possible;
  • complying with all applicable laws, policies, and professional obligations.

Workers must not perform services outside their training, qualifications, legal authority, professional scope, Rose Hill policies, or the applicable care plan.

13. Employment Status and Hours of Work

Employment status, contractor status, assignment status, hours of work, scheduling, availability, and duties will be determined by Rose Hill Care at Home Inc. based on business needs, client needs, worker qualifications, worker availability, applicable law, and the applicable written agreement.

A worker may be classified as one of the following, depending on the role and agreement:

  • full-time employee;
  • part-time employee;
  • casual employee;
  • temporary help agency assignment employee;
  • independent contractor;
  • assignment-based worker;
  • other lawful working arrangements.

Work schedules and assignments may change depending on client needs and operational demands. Rose Hill Care at Home Inc. will make reasonable efforts to provide notice of schedule changes where practical.

Employees are entitled to applicable minimum employment standards under the Employment Standards Act, 2000 and other applicable laws.

Independent contractors are responsible for their own obligations as set out in their contractor agreement and applicable law. Nothing in these Terms is intended to incorrectly classify a worker or remove rights that cannot legally be removed.

14. Compensation and Benefits

Compensation will be outlined in the applicable employment agreement, contractor agreement, offer letter, assignment confirmation, payroll record, invoice arrangement, or other written agreement.

Compensation may include hourly wages, salary, contractor fees, assignment rates, overtime pay where applicable, vacation pay where applicable, statutory holiday pay where applicable, mileage or travel reimbursement where applicable, and other amounts required by law or agreement.

Employees will receive all minimum entitlements required under the Employment Standards Act, 2000 and other applicable laws.

Independent contractors will be paid according to their contractor agreement and applicable invoicing or payment terms.

Employee benefits, if any, will depend on the worker’s role, employment status, eligibility, applicable plan documents, and Rose Hill policies.

Nothing in these Terms guarantees any specific wage, salary, rate, benefit, number of hours, assignment, client, location, or schedule unless confirmed in a written agreement.

15. Professional Obligations Under Ontario Law

All PSWs, RNs, caregivers, employees, contractors, and other workers must provide services ethically, respectfully, safely, and professionally.

Workers must:

  • uphold client dignity, respect, privacy, independence, and autonomy;
  • follow Rose Hill policies and procedures;
  • follow applicable care plans and service instructions;
  • maintain confidentiality of client, worker, and business information;
  • comply with privacy requirements, including requirements related to personal information and personal health information;
  • comply with health and safety requirements, including infection control practices and use of PPE where required;
  • maintain required training, certifications, registration, and documentation;
  • report incidents, abuse, neglect, safety concerns, client condition concerns, privacy concerns, or workplace injuries to Rose Hill management as soon as possible;
  • comply with applicable professional standards where the worker is regulated by a professional body;
  • comply with all applicable Ontario and Canadian laws.

Registered Nurses must maintain any required registration, good standing, and professional obligations applicable to their role.

PSWs and other care workers must follow Rose Hill policies, applicable care standards, client-site rules where applicable, and any legally applicable standards for their role.

16. Confidentiality

All employees, contractors, PSWs, RNs, caregivers, companions, and other workers must keep client information, health information, care notes, schedules, employee information, business information, documents, photos, and other confidential information private and secure.

Workers must not disclose confidential information except as required for their role, authorized by Rose Hill Care at Home Inc., authorized by the client or legal representative where applicable, or permitted or required by law.

Confidentiality obligations continue after the working relationship with Rose Hill Care at Home Inc. ends.

17. Termination of Employment or Working Relationship

Rose Hill Care at Home Inc. may end an employment relationship, contractor relationship, assignment, placement, or application in accordance with the applicable written agreement and applicable law.

Reasons may include, but are not limited to:

  • misconduct;
  • falsification or misrepresentation of information;
  • expired, missing, or invalid required documentation;
  • failure to meet eligibility requirements;
  • failure to follow Rose Hill policies or procedures;
  • failure to follow care plans or safety requirements;
  • privacy or confidentiality violations;
  • client complaints or service concerns;
  • abuse, neglect, harassment, discrimination, or unsafe conduct;
  • performance concerns;
  • attendance or reliability concerns;
  • lack of available work or client assignments;
  • business or operational needs;
  • violation of applicable law.

Employees will receive any minimum notice, pay, benefit continuation, vacation pay, public holiday pay, severance pay, or other entitlements required by the Employment Standards Act, 2000 or other applicable law, subject to any valid written employment agreement.

Contractor relationships may be ended according to the applicable contractor agreement and applicable law.

Nothing in these Terms limits any right or obligation that cannot legally be limited.

18. Liability and Indemnification

Rose Hill Care at Home Inc. strives to provide a safe, respectful, and supportive environment for clients, employees, contractors, PSWs, RNs, caregivers, and other workers.

All clients, families, representatives, employees, contractors, and workers agree to follow applicable laws, Rose Hill policies, service agreements, care plans, safety protocols, privacy requirements, and reasonable instructions related to services.

To the fullest extent permitted by law, Rose Hill Care at Home Inc. is not responsible for losses, damages, injuries, claims, or disputes caused by:

  • false, incomplete, or misleading information provided by a user, client, applicant, worker, or representative;
  • misuse of the website;
  • unauthorized access caused by a user’s failure to protect account credentials;
  • actions outside an agreed care plan or written agreement;
  • unauthorized private arrangements made outside Rose Hill Care at Home Inc.;
  • conduct that is unlawful, intentional, reckless, fraudulent, or outside the person’s role or authority.

Nothing in this section limits any liability, right, responsibility, or obligation that cannot legally be limited under applicable law.

You agree to indemnify and hold harmless Rose Hill Care at Home Inc., its directors, officers, employees, contractors, representatives, and service providers from claims, losses, damages, costs, or expenses arising from your misuse of the website, your violation of these Terms, your unlawful conduct, your breach of a written agreement, or information you submit that is false, misleading, unlawful, or harmful.

19. Waiver of Responsibility and Legal Limits

Rose Hill Care at Home Inc. provides guidance, procedures, policies, training, scheduling, and support to workers as applicable to their role.

However, workers remain responsible for performing their duties ethically, safely, professionally, and in accordance with Rose Hill policies, applicable care plans, confidentiality obligations, privacy requirements, health and safety requirements, and applicable law.

Clients and representatives remain responsible for providing accurate information, maintaining a safe environment, respecting workers, and following the applicable service agreement and care plan.

No waiver, disclaimer, limitation of liability, or indemnity in these Terms applies where it would be prohibited by law.

Nothing in these Terms limits:

  • minimum employment standards;
  • occupational health and safety duties;
  • human rights obligations;
  • privacy or health information obligations;
  • workers’ compensation obligations;
  • consumer protection rights;
  • professional obligations;
  • liability that cannot legally be excluded;
  • any other right or obligation that cannot legally be limited.

This may include staff profiles, testimonials, website content, social media, promotional materials, or other content that highlights our services or team members.

Marketing consent is optional and may be withdrawn by contacting Rose Hill Care at Home Inc., subject to reasonable processing time and any legal or practical limitations.

23. Payments, Fees, Cancellations, and Refunds

Fees, payment terms, minimum shift length, travel charges, holiday rates, cancellation rules, refund rules, deposits, late payment rules, and billing details will be confirmed in a separate client service agreement, quote, invoice, online checkout page, written confirmation, or other agreement.

Rose Hill Care at Home Inc. may require payment before or after services are provided, depending on the service and agreement.

If online payment is available, payment may be processed by third-party payment providers. Rose Hill Care at Home Inc. does not intend to store full payment card details directly on its website.
